The Hon'ble Sri Justice C.V.Nagarjuna Reddy Writ Petition No.7327 of 2009 Dated 30.09.2015 Between:

M/s.Suresh Road Carriers rep. by its Proprietor J.Suresh ... Petitioner and The Collector (Civil Supplies) Kakinada

...Respondent

Counsel for the petitioner: Mrs.G.Jhansi Counsel for the respondent: AGP for Civil Supplies (AP) The Court made the following:

O r d e r :

This Writ Petition is filed for a Mandamus to declare the action of the respondent, in seizing the petitioner's lorry bearing

registration No.AP 29 T 7277 and initiating proceedings under Section 6-A of the Essential Commodities Act, 1955 (for short 'the Act'), as illegal and arbitrary.

A perusal of the proceeding sheet shows that by interim order, dated 08-04-2009, this Court has directed release of the aforesaid lorry to the petitioner subject to his furnishing bank guarantee for a sum of Rs.1 lakh.

Smt.G.Jhansi, learned Counsel for the petitioner, submitted that in pursuance of the said interim order, the respondent has released the lorry to the petitioner. She is, however, unable to state whether the proceedings under Section 6-A of the Act have been concluded or not.

Inasmuch as the limited grievance of the petitioner pertains to seizure of his lorry, with the interim direction of this Court to release the same, his grievance stood redressed. Hence, the Writ Petition is disposed of as infructuous.

As a sequel to disposal of the Writ Petition, WPMP.No.9611 of 2009, filed by the petitioner for interim relief, is disposed of as infructuous.
