THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.8337 of 2017 ORDER:

This Criminal Petition, under Section 482 Cr.P.C is filed to quash the Order dt.08.03.2017 in CFR No.3291 of 2015 in C.C.No.212 of 2015 passed by I Additional Junior Civil Judge, Gurazala, Guntur District, Andhra Pradesh, allowing the petition taking cognizance of the offences punishable under sections 147, 452, 354, 323, 509, 427, 506 r/ w 149 IPC on the protest petition filed by the complainant. During the course of hearing, learned counsel for the petitioners, requested this Court to dispense with the appearance of Ac cused Nos. 3 to 37 before the Court below enabling him to file appropriate application under Section 239 Cr.P.C.

Learned counsel for the respondent reported no objection. In view of the concession given by the learned counsel for respondent, the appearance of the accused/ A.3 to A.37 before the trial Court is dispensed with. However, the petitioners/ A.3 to A.37 are directed to appear before the trial Court as and when required by the Court. With the above direction, this Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
