THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.37783 OF 2014 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the Orders in C.No.15/H.S/SDPO-RCPM/2014, dated 10.09.2014, issued by the third respondent as illegal and arbitrary and consequently to set aside the same.

Heard and perused the material.

Learned counsel for the petitioner submits that two cases are registered against the petitioner and others in 2010 and that the said cases are arising out of family disputes and the said cases are settled before the Lok Adalat. He further submits that the petitioner has not committed any offences and that the petitioner is not involved in any other offence after 2010, but the third respondent opened a rowdy sheet against the petitioner on the basis of the earlier two crimes, which were compounded before the Lok Adalat.

Considering the facts and circumstances of the case, the petitioner is directed to make a representation to the third respondent stating that he has not committed any offence and that he is a student, and on filing of such application, the third respondent is directed to consider the representation and pass appropriate orders. Further, the third and fourth respondents are directed not to call the petitioner to the police station on the basis of the rowdy sheet pending against the petitioner. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 08.11.2016 pln
