THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 18124 of 2019 O R D E R:

In this writ petition, petitioner challenges the proceedings dated 25.07.2019 issued by respondent No.3-Divisional Manager, TSRTC, Karimnagar Division.

Through the impugned proceedings, the petitioner was suspended from service as he is doing business of promoting life insurance policies from his subordinates by using his influence, which constitutes serious misconduct as per Regulation No.28(xvii), (xxxi) and (xxxii) of TSRTC Employees (Conduct) Regulations, 1963. Sri A.Jagan, learned counsel for the petitioner, submits that the petitioner is going to retire within three months and putting him under suspension would cause agony and also a black mark on the unblemished service rendered by him.

On instructions, Sri A.Ravi Babu, learned Standing Counsel for the respondents, submits that without there being any further delay, the enquiry would be completed within four weeks. Having regard to the respective submissions and in view of the fact that suspension pending enquiry cannot be interfered with except in exceptional cases and in the case of mala fides, this Court is not inclined to interfere with the impugned proceedings. Considering the submission of the learned Standing Counsel that the enquiry would be completed within four weeks, the writ

petition is disposed of with the direction to the respondents to complete the enquiry and pass orders within the outer time-limit of six weeks from today, failing which, the petitioner shall be reinstated into service, subject to his cooperating with the enquiry without seeking adjournments.
