THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.11182 of 2005 ORDER:

Heard the learned counsel for petitioner.

2. This Writ Petition was filed challenging the action of the second respondent in auctioning the land in survey No.989 admeasuring 5.19 acres on 30.04.2005 in spite of the representation dated 25.04.2005 and for consequential cancellation of the bid submitted by the third respondent.

3. Now the counter affidavit is filed on behalf of the respondents 1 and 2 stating that the auction conducted on 30.04.2005 was cancelled as the third respondent could not deposit the bid amount as per the terms and conditions of the auction. It was also stated that there was no representation from the villagers for grant of house sites and if there is any representation from the villagers in the future, it will be considered subject to availability of the government lands.

4. In view of the submission made on behalf of the respondents 1 and 2, this Writ Petition is dismissed as infructuous. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed.
