THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.34208 OF 2016 ORDER:
This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the inaction of the second respondent in failing to register the appeal in dispatch No.588/2016 dated 23.09.2016 filed by the petitioner challenging the orders and decree dated 18.07.2016 passed by the third respondent in File No.TWA2/171/2015, as illegal and arbitrary. Heard the learned counsel for the petitioners, the learned Government Pleader of Social Welfare, learned Assistant Government Pleader for Home and Sri M.Krishna Murthy, learned counsel for R-5.
Though various grounds are raised in the Writ Petition, the learned counsel for the petitioners restricts his prayer seeking a direction for early disposal of the appeal filed by the petitioners against the orders passed by the third respondent. The same is not seriously opposed by the other side. Having regard to the above, the Writ Petition is disposed of directing the 2nd respondent herein to dispose of the appeal filed by the petitioners against the orders dated 18.07.2016 passed by the third respondent herein, in accordance with law, after hearing both the parties, as early as possible, preferably within a period of three months from the date of receipt of a copy of this order. The second respondent shall forthwith hear the stay application filed by the petitioner along with the Appeal and pass orders thereon in
accordance with law at the earliest. Till such time, status quo as on today to be maintained.
Miscellaneous petitions pending in this writ petition, if any, shall stand closed. No costs.
