THE HON'BLE SRI JUSTICE T.AMARNATH GOUD WRIT PETITION NO.2519 OF 2006 ORDER:

Aggrieved by the action of the respondents in not issuing pattadar passbooks and title deeds to the petitioners in respect of land admeasuring Ac.4-11 guntas in Sy.No.126 of Narsingi Village, Rajendra Nagar Mandal, Ranga Reddy District, the present writ petition is filed.

Petitioner No.1 originally filed the present writ petition. During the pendency of the writ petition, petitioner Nos.2 and 3 and respondent Nos.3 and 4 were impleaded as per the order of this Court dated 15.11.2010 in WPMP.Nos.17833/2010 and 17885/2010, claiming their rights in the subject land. 3.

It is the case of the first petitioner that his grandfather purchased the subject land from one Neelam Sivaiah and another by way of a registered sale deed dated 86 of 1342 Fasli. After the death of his grandfather, himself, his father and brother approached the second respondent for mutating their names in the revenue records in respect of the subject land, but the second respondent refused to do so on the ground that the subject lands belong to the Government. Challenging the same, they filed O.S.No.228 of 1991 on the file of the Court of II Additional Subordinate Judge, Ranga Reddy District at Saroornagar (for short, Court below) for declaration and perpetual injunction against the respondents. The Court below decreed the said suit by judgment

and decree 26.11.1996. In spite of the same also, the respondents neither mutated the names of the petitioners in the revenue records in respect of the subject land nor issued pattadar passbooks and title deeds to them.

In the facts and circumstances of the case, the writ petition is disposed of, directing the petitioners and respondent Nos.3 and 4 to file fresh representations with regard to their claims, enclosing all the necessary documents, before the second respondent within a period of four weeks from the date of receipt of a copy of this order. On receipt of such representations, the second respondent shall consider the same and pass appropriate orders thereon, in accordance with law, within a period of eight weeks thereafter. No costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
