HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.13729 of 2006 ORDER:
This writ petition under Article 226 of the Constitution of India, is filed by the petitioner seeking to declare the action of the Commissioner, Karimnagar Municipal Corporation - 1st respondent, in interfering with the possession and enjoyment of the petitioner in respect of the land admeasuring Acs.2-00 guntas in Sy.No.1104/ D1 of Karimnagar District, allotted by the Government to the husband of the petitioner in lieu of the compensation for the land value acquired for the purpose of construction of Buildings, as arbitrary and illegal, and consequently direct the respondent Nos.2 to 5 to conduct the survey and to fix the boundary stones and to mutate the name of the petitioner in the revenue records duly issuing pattedar pass book and title deeds. Heard and perused the material available on record. The 1st respondent filed counter stating that they are not interfering with the possession of the petitioner over the land in question.
When the matter is taken up for hearing, it is informed that the respondents are not proceeding with the acquisition of the land of the petitioner. Learned counsel for the petitioner submitted that if it is the stand taken by the respondents, the petitioner is not interested in the land allotted to her husband by the government in lieu of the compensation of the land value acquired for the purpose of construction of buildings.
Recording the above, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
