THE HONOURABLE SRI JUSTICE K. LAKSHMAN CRIMINAL PETITION No.4659 OF 2022 ORDER:
Pursuant to the order dated 08.06.2022, learned Public prosecutor, on instructions, would submit that there is a Drug Disposal Committee constituted in terms of Section 52 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short, 'the NDPS Act, in Suryapet District.
2. In view of the same, this Criminal Petition is disposed of granting liberty to the petitioner herein, the owner of the vehicle, to approach the said Drug Disposal Committee by way of filing an appropriate application and on filing of such application, the Drug Disposal Committee shall dispose of the same in accordance with law as expeditiously as possible keeping in view, the principle laid down by the Apex Court in Sunderbhai Ambalal Desai Vs. State of Gujarat1.
3. As a sequel, the miscellaneous Petitions, pending if any, shall stand closed.
