THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23816 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the first respondent in not allowing the management of the petitioner college/society to operate its account bearing No.62030687631 though no stay is extended in ex parte ad interim injunction order, dated 09.05.2016 passed in I.A.No.17 of 2016 in O.P.No.1 of 2016 filed by the second petitioner as illegal and arbitrary and consequently, to direct the first respondent to allow the management of the petitioner college/society to operate its account bearing No.62030687631.

Heard and perused the material.

Learned counsel for the petitioner submits that though there is no extension of stay in respect of operation of the account of the petitioner college/society, the first respondent is not allowing the petitioner college/society to operate its account and as such, prays this Court to direct the first respondent to allow the management of the petitioner college/society to operate its account stated above. Learned counsel for the first respondent submits that it is true that the order of stay is communicated to them on an earlier occasion and subsequently, no order of extension of stay in favour of the second respondent is communicated to the first respondent.

Considering the facts and circumstances of the case, as there is no order of extension of stay is communicated to the first respondent, the first respondent is hereby directed to allow the petitioner college/society to operate the account which is stayed by the Court below in O.P.No.1 of 2016.
