Heard learned counsel for the petitioner, learned Government Pleader for Municipal Administration and Sri S. Prabhakar Reddy, learned standing counsel for GHMC. 2.

Petitioner alleges that neighbour to the petitioner, who is arrayed as respondent No.4 in the writ petition and who is the brother of the petitioner, is undertaking construction by digging cellar without obtaining permission. Petitioner claims to have filed several complaints against the illegal construction taken up by respondent No.4. Alleging inaction on the said complaints, this Writ Petition is filed.

Learned standing counsel, on instructions, submits that respondent No.4 has obtained permission for construction of cellar + ground + three upper floors on 16.04.2019. He further submits that the respondent - GHMC would take appropriate action, if respondent No.4 undertakes construction in deviation of the building permission already granted to him.

Since building permission was already granted to the unofficial respondent, petitioner cannot contend that the unofficial respondent is making construction illegally.
