This Writ Petition came to be filed under Article 226 of the Constitution of India seeking issuance of writ of mandamus declaring the action of the respondent-police filing charge sheet vide C.C.No.108 of 2019 on the file of the Additional Judicial First Class Magistrate at Nirmal against the petitioners and seizing the material 114 bags of Sagar Pan Masala, which is not tobacco product as illegal and arbitrary and consequently to quash the proceedings in C.C.No.108 of 2019. 2.

Learned counsel for the petitioners and the learned Government Pleader for Home submitted that the issue involved in this petition is squarely covered by the order, dated 27.08.2018 passed by this Court in Criminal Petition No.3731 of 2018 and batch.

In view of the above submission, the Writ Petition is allowed in terms of the order, dated 27.08.2018 passed in Criminal Petition No.3731 of 2018 and batch.
