HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CONTEMPT CASE No.2648 OF 2016 ORDER:
The contempt case is filed alleging violation of the orders dated 10.06.2016 passed in WP.No.18198 of 2016, wherein this Court directed the respondents to dispose of the application of the petitioner for survey.
The respondent filed counter affidavit stating that after considering the petitioner's application an endorsement dated 20.06.2016 was issued rejecting the petitioner's request for survey of the subject land.
Learned counsel for the petitioner states that the respondent without considering petitioner's application in proper perspective passed the endorsement, erroneously.
In this case, the direction in the writ petition is only to dispose of the application of the petitioner and as per the said orders the respondents considered the application and passed endorsement dated 20.06.2016 rejecting the application of the petitioner. More so, this Court cannot decide the validity of the order in the contempt case. In view of the above, I do not see any violation of the orders passed by this Court by the respondents.
Accordingly, the Contempt Case is dismissed. However, it is open for the petitioner to challenge the endorsement dated 20.06.2016. No order as to costs.
As a sequel, miscellaneous applications, if any pending in the Contempt Case shall stand closed.
