THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.30229 of 2017 ORDER:

This Writ Petition is filed seeking a direction to the respondents to remove the encroachments in Survey No.177 of Pottilanka Village, Kadiyam Mandal in East Godavari District, and for a consequential direction to construct a Sulabh Complex in the above survey number as per resolution No.17, dated 10.07.2017 passed by the fourth respondent.

It appears that pursuant to the aforesaid resolution, the Lok Adalat passed an award on 11.07.2017 to take further steps for implementation of the resolution and the petitioners, without bringing the said fact to the notice of the concerned authorities, filed the present Writ Petition.

Though the petitioners may have a genuine grievance with regard to the necessity of a Sulabh Complex, it is for the authorities to take appropriate action pursuant to the resolution passed by the Gram Panchayat.

In the circumstances, this Writ Petition is disposed of giving liberty to the petitioners to bring it to the notice of the concerned authorities who shall take the facts into consideration and take appropriate action in this regard. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
