THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.16432 OF 2016 ORDER:

This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.'), is filed to quash the order dated 09.09.2016 in Crl.M.P. No.1230 of 2016 in C.C. No.323 of 2015 passed by the V Special Magistrate, Kukatpally, at Miyapur, Rangareddy District, whereby the learned Magistrate received documents subject to proof and relevancy and admissibility.

The order under challenge on various grounds, more particularly, the earlier application filed by the second respondent in Crl.M.P.No.1022 of 2016 in C.C. No.8 of 2016 was dismissed by order dated 05.10.2016, but the present petition is allowed without any specific reason. However it is contended, during hearing, that if the matter is allowed to be proceeded, it will have its own impact on the defence set up by the petitioner in the other two cases, that may lead to conflicting judgments. But this is not appropriate application to set aside the order, when there is no illegality in the order under challenge. However, it is left open to the petitioner to file appropriate application for any relief available to him before the trial court or before the competent court.

With the above observation, the criminal petition is disposed of.

CRLP_16432_2016 MSM, J - 2 - Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
