HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.914 of 2017 ORDER :
Heard Sri Nimmagadda Satyanarayana, learned counsel for the petitioners, who requests to relax the condition imposed by the learned IX-Additional Sessions Judge, Kovvur, West Godavari District. 2.
It is his submission that while granting bail on 13.02.2015 in Crl.M.P.No.95 of 2015 in Crime No.414 of 2014, Jangareddigudem Police Station, which was filed by the petitioners/A.1 to A.6, A.8 to A.11, A.13 and A.16, the Sessions Court imposed a condition that they shall appear on every Wednesday and Sunday between 10.00 a.m. and 5.00 p.m., till further orders. The said condition was modified at the instance of the petitioners to that of appearance of the petitioners once in a month i.e., on every second Saturday between 10.00 a.m. and 5.00 p.m. till filing of charge sheet vide order dated 01.06.2015 in Crl.M.P.No.144 of 2015.

The submission of the learned counsel for the petitioners is that though, the crime relates to the year 2014, the Investigating Officer has not yet filed charge sheet and the petitioners have been regularly complying with the modified condition imposed by the learned Sessions Judge, dated 01.06.2016, and, it is causing hardship to the petitioners as they are agriculturists.

The learned Additional Public Prosecutor for the State of Andhra Pradesh would represent that he has to find out the reasons for the delay in filing the charge sheet.

In view of the submissions of the learned Additional Public Prosecutor, the modified conditional order dated 01.06.2015, has to be relaxed due to non-filing of the charge sheet by the Investigating Officer though, the crime relates to the year 2014.

Accordingly, the aforesaid condition imposed by the IX-Additional Sessions Judge, Kovvur, in Crl.M.P.No.144 of 2015 in Crl.M.P.No.95 of 2015 in Crime No.414 of 2014 is relaxed by allowing the criminal petition.
