HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18123 of 2019 ORDER:

This Writ Petition is filed assailing the action of the respondents in calling the petitioner to police station at the instance of 5th respondent and threatening him to settle the land dispute, as illegal and arbitrary.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for respondents 1 to 4. Learned Assistant Government Pleader for Home appearing on behalf of respondents 1 to 4 produced written instructions dated 28.08.2019 stating as follows:

"It is submitted that in fact a case is registered against the petitioner Krishna @ Kishan in Crime No.891/2019, U/s.420 IPC of L.B.Nagar Police Station on 8.8.2019 basing on the complaint of one Danturi Harishanker, wherein the petitioner is arrayed as Accused No.1 in the said case.

It is submitted that in order to divert the attention of the investigating officer from investigating the above case, the petitioner had come up with present writ petition to bring pressure on the police officials, all the averments and contention raised in the writ affidavit are false are denied."

In view of the same, this Writ Petition is disposed of granting liberty to the petitioner to agitate his rights against registration of crime and to avail alternate remedies available to him under law. There shall be no order as to costs. Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
