HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.2006 OF 2017 ORDER:

This writ petition is filed declaring the action of the respondents particularly the 3rd respondent and its officials in trying to interfere with peaceful possession and enjoyment of the petitioner's property, as illegal and arbitrary. Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue. A perusal of the writ affidavit goes to show that a civil litigation is pending between the petitioners and the unofficial respondents and proceedings under Section 145 Cr.P.C. are also pending.

In view of the same, this Court cannot go into the disputed questions of fact and declare the title of the parties. Therefore, I do not see any reason to entertain the writ petition. Accordingly, the writ petition is dismissed. However, the petitioners are at liberty to work out their remedies by approaching the appropriate forum. No costs. Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
