THE HON'BLE SRI JUSTICE DILIP B.BHOSALE AND THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT APPEAL No.664 of 2007 JUDGMENT: (per the Hon'ble Sri Justice Dilip B.Bhosale) Sri J.C.Francis, learned Advocate on record for respondent No.2, submits that respondent No.2, who is the contesting respondent in the instant appeal, has passed away about four years ago.

2. In view thereof, we have no option, but to dispose of this appeal as abated. Order accordingly. This, however, shall not preclude the appellant from taking steps for bringing legal representatives of deceased respondent No.2 on record and pray for setting aside the abatement and for condonation of delay in filing the application for bringing the legal representatives on record. We also make it clear that we have not entered into merits of the case at all. Miscellaneous petitions, if any, also stand disposed of.
