HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 10963 of 2000 ORDER:

The Writ Petition is filed seeking following reliefs: i.

declare the action of the respondents in not regularizing the services of the petitioners as L.H.D. Operators as illegal and arbitrary;

ii.

direct the respondents to regualarise the services of the petitioners as L.H.D. Operator; and iii.

pass such other order or orders as this Honourable Court deems fit.

When the matter is taken up for hearing, learned Standing Counsel for first respondent - Singareni Collieries had placed before this Court certain information pertaining to petitioners.

The information furnished by first respondent - Singareni Collieries regarding petitioner Nos.1 to 4 reads thus:

Petitioner No.1 - Sri Thalla Mogilaiah, EC.No.1145756, General Mazdoor, GDK9 was dismissed under absenteeism with effect from 25.07.2001 holding of misconduct under company's standing order No.25.31. During his dismissal his designation is General Mazdoor. All terminal benefits are settled to Sri Thalla Mogilaiah.

Date of Birth - 22/09/1958 Date of appointment - 22/12/1983 Date of retirement - 01/10/2018 Date of dismiss - 25/07/2001 Date of promotion to General Mazdoor cat-II -01/01/1996 Petitioner No.2 - Sri Ragam Venkat Narsaiah S/o.Ramaiah Ec.No.1153911, SDI/LHD operator was declare unfit by corporate medical board for further services and terminated from the service

vide GM RG-II letter No.RG2/PER/10MU/1596 dated 07.07.2010. As such his name was removed from the rolls of the company with effect from 07.07.2010. All terminal benefits are settled to Sri Ragam Venkat Narsaiah S/o.Ramaiah. Dependant employment was provided to his son Sri Ragam Ramesh. The following are the personal details. Date of Birth - 23/10/1956 Date of appointment - 06/01/1982 Date of retirement - 01/02/2016 Date of promotion to SDI/LHD helper cat IV - 01/09/2005 Date of promotion to SDI/LHD helper cat VI - 10/02/2009 Petitioner No.3 - Sri Endla Mogili Ec.No.1154179, SDI/LHD operator was declare unfit by corporate medical board for further services and terminated from the services vide GM RG-II letter No.RG2/PER/10MU/504 dated 15.02.2012. As such his name was removed from the rolls of the company with effect from 17.02.2012. All terminal benefits are settled. Dependant employment was provided to his son Sri Endla Ramkumar. The following are the personal details.

Date of Birth - 15/06/1955 Date of appointment - 20/07/1980 Date of retirement - 01/07/2015 Date of promotion to SDI/LHD helper cat IV - 01/09/2005 Date of promotion to SDI/LHD helper cat VI - 10/02/2009 Petitioner No.4 - Sri Sandupatla Satyanarayana Reddy S/o.

Raj Reddy was dismissed under absenteeism with effect from 25.07.2001 holding of misconduct under company's standing order No.25.31. During his dismissal his designation is General Mazdoor. All terminal benefits are settled to Sri Sandupatla Satyanarayana Reddy.

Date of Birth - 22/09/1952 Date of appointment - 02/11/1983 Date of retirement - 01/10/2012 Date of dismiss - 25/07/2001 Date of promotion to General Mazdoor cat-II - 01/07/1998 As can be seen from the above, the grievance, of the petitioners, has been redressed in one way or other. Copy of the said information was also made available to the

learned counsel for the petitioners on the last date of hearing, and the matter was adjourned to this day to enable him to obtain instructions from the petitioners. However, no contra material is produced before this Court by the learned counsel for the petitioners. In view of subsequent developments, nothing survives for consideration.

The Writ Petition is, accordingly, closed.
