HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.11146 OF 2010 ORDER:

The relief sought for in this Writ Petition is to declare the action of the respondents in threatening to remove the tower without issuing any notice, and without processing the petitioner's application, as arbitrary and illegal.

The petitioner claims to have erected a tower, and to have submitted an application, on 10.03.2010 seeking permission of the Corporation to do so. The petitioner appears to have waited for thirty days, and to have then erected the tower. It is their grievance that the respondents were threatening to remove the tower, without putting them on notice and without giving them an opportunity of being heard. Suffice it, therefore, to dispose of the Writ Petition directing the respondent corporation not to remove the subject structure, except after putting the petitioner on notice, and after giving them an opportunity of being heard.

The Writ Petition stands disposed of accordingly. The miscellaneous petitions pending, if any, shall stand closed. No costs. _________________________________ RAMESH RANGANATHAN, ACJ Date: 17.11.2017.
