HON'BLE SRI JUSTICE RAJA ELANGO Criminal Revision Case No.412 of 2015 ORDER:

This revision is preferred challenging the order dated 24-11-2014 passed by the Sessions Judge, Guntur in Criminal Appeal No.220 of 2014, wherein the learned Sessions Judge allowed the appeal in part by confirming the finding of the Collector and District Magistrate, Guntur that the appellant was guilty of the charges of indulging in clandestine business and by modifying the order of penalty from 25% confiscation of stocks to that of 5% of the stock. Heard the learned counsel on either side and perused the material available on record.

Even though this Court is not inclined to interfere with the concurrent findings of the Courts below, due to persuasion of the learned counsel for the petitioner and also taking into consideration the meager quantity of rice found in the possession of the petitioner, the order of the lower appellate Court to cancel the bank guarantee value of Rs.2,00,000/- submitted by the petitioner and out of which draw a Demand Draft for Rs.94,588/- for adjusting the same into Civil Supplies Head of Account is modified to cancel the bank guarantee value of Rs.2,00,000/- submitted by the petitioner and out of which draw a Demand Draft for Rs.50,000/- for adjusting the same into Civil Supplies Head of Account on or before 20-06-2015. Accordingly, the Criminal Revision Case is disposed of. Consequently, the Miscellaneous Petitions pending, if any, in this revision shall stand closed.
