HONOURABLE SRI J USTICE M.S.K . J AISWAL CRIMINAL PETITION No. 13126 of 2016 ORDER:

The criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in Cr.No. 294 of 2016 on the file of Station House Officer, Police Station, Nandyal II Town, Nandyal, Kurnool District, registered for the offences punishable under Sections 403, 419,420,468,472 read with Section 34 IPC. Heard learned counsel appearing for the petitioner/Accused No. 11, and learned Additional Public Prosecutor, representing the State.

Having heard the learned Counsel on either side and gone through the material available on record, it is obvious that specific allegations were made against the petitioner/Accused No.11 in the complaint. This is a matter which requires investigation by the police. The truth or otherwise of the allegations can only be decided during course of investigation or trial. I see no ground to interdict the investigation at this stage and quash the first information report.

However, the learned Counsel for the petitioner/Accused No.11 submits that eventhough the petitioner has obtained Anticipatory bail, the investigating agency is insisting his presence every day and thereby it is causing much inconvenience to him. He further submits that in view of booking of the aforesaid crime, the petitioner herein/Accused No.11 was suspended from service.

Considering the facts and circumstances of the case and submissions of the learned Counsel for the petitioner, the Criminal Petition is disposed of, directing the investigating agency to proceed with the investigation and complete the same as expeditiously as possible. It is further made clear to the Investigating agency that even for any specific purpose, the presence of petitioner/Accused No.11 is required, he should be given prior notice and call for police Station. Miscellaneous petitions pending consideration if any in the Criminal Petition shall stand closed in consequence. No order as to costs.
