THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI C.C.No.1152 OF 2019 O R D E R :

When the matter is taken up for hearing, it is submitted by the learned Government Pleader for the respondents that in compliance of the order passed by this Court in W.P.No.11321 of 2019 dated 11.06.2019, the respondents have issued proceedings dated 30.10.2019 deciding to continue the petitioner under suspension after reviewing the suspension order impugned in the writ petition.

Learned counsel for the petitioner submits that so far the respondents have not issued charge sheet, thereby violated the orders passed by this Court in W.P.No.11321 of 2019 dated 11.06.2019 and also the law laid down by the Hon'ble Apex Court in Ajay Kumar Choudhary vs. Union of India1.

This Court, having considered the rival submissions of the learned counsel appearing for the respective parties, is of the considered view that the respondents have complied with the order passed by this Court in W.P.No.11321 of dated 11.06.2019 by issuing proceedings dt.30.10.2019. If the petitioner is still aggrieved by the said order, he is at liberty to challenge the same in appropriate proceedings.

Accordingly, the Contempt Case is closed.

Miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
