THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 18638 of 2019 ORDER:
In this writ petition, petitioner is complaining inaction on the part of the respondent authorities in mutating the revenue records with respect to the property to an extent of Acs.8.00 guntas and Acs.6.30 guntas, in total Acs.14.30 guntas, covered by Survey Nos.187 (Acs.4.00 guntas) and 188 (Acs.10.30 guntas) respectively, situated at Vattinagulapally Village, Gandipet Mandal, Ranga Reddy District, as the said property came to be purchased by virtue of registered sale deeds dated 03.09.1998 and 14.09.1998.
It is to be noted that on an application submitted by the petitioner under Section 5 of the Telangana Rights in Land and Pattadar Passbooks Act, 1971, for mutation with respect to the subject property, the third respondent - Deputy Collector & Tahsildar, Rajendranagar Mandal, Ranga Reddy District, by categorically stating that the claim of the petitioner for sanction of mutation was already examined in detail and the same came to be disposed of vide proceedings dated 25.02.2005 by the then Deputy Collector & Mandal Revenue Officer, Rajendranagar Mandal, rejected the said application vide proceedings dated
CKR, J W.P.No.18638 of 2019 06.12.2017. In other words, the claim of the petitioner already stands disposed of vide proceedings dated 25.02.2005 for whatever reasons. Hence, as long as the proceedings dated 25.02.2005 is in force, there cannot be any writ of Mandamus issued with respect to the same subject matter. In those circumstances, the writ petition is disposed of giving liberty to the petitioner to workout his remedies with respect to the proceedings dated 25.02.2005 in accordance with law.
Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
