THE HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 18620 OF 2013 ORDER:

This Writ Petition is filed to declare the action of respondent Nos. 1 to 3 in treating the property bearing house No. 16/65-66, Gundugolanu, Bhimadolu Mandal, West Godavari District, known as M/s. Sri Vagwala Seshamma Satram, within the purview of the provisions of the Andhra Pradesh Endowments Act, 1987, and thereby appointing respondent No. 4 as a Single Trustee as illegal and arbitrary.

Today when the matter came up for hearing, learned counsel for the petitioner submits that the subject property is private property of the petitioner and the respondents are treating the said property as the property of Satram.

In view of the facts and circumstances of the case, if the petitioner is owner of the subject property, he is given liberty to avail the remedies which are available to him under law. 4.

With the liberty given to the petitioner, the Writ Petition is disposed of. Pending miscellaneous petitions, if any, shall stand dismissed in consequence. No costs.
