Heard the learned counsel for the petitioner and the learned Government Pleader for Mines and Geology for the respondents. With their consent, this Writ Petition is disposed of at the stage of admission. 2.
The learned counsel for the petitioner firm submitted that the petitioner firm had applied for grant of quarry lease for Black Granite in an extent of 4.80 Hects in Survey No.673, Chilvakodur Village, Golapalli Mandal, Jagithyal District on 18.01.2020 to the respondents who in turn forwarded the same to the Tahsildar for issuance of No Objection Certificate. The Tahsildar, Gollapalli has forwarded the classification, availability and No Objection Certificate to Assistant Director of Mines and Geology vide Lr.No.B/296/2020, dated 29.09.2020 as per G.O.Ms.No.4, dated 19 01.2015. The Assistant Director of Mines forwarded the same to the 3rd respondent for passing orders as he is the competent authority for granting quarry lease under T.S.Minor Mineral Concession Rules, 1966 and the same is pending. The petitioner had complied with all the deposits along with the application, but no action had been taken by the respondents till date. Hence, the petitioner sought for a direction to the respondents to dispose of his application dated 18.01.2020 at the earliest.

Learned Government Pleader for Mines and Geology reported no objection to issue a direction to the respondents to consider the application of the petitioner within a stipulated period.

In view of the submissions made by the learned counsel for the petitioner and the learned Government Pleader, the writ petition is disposed of directing the 2nd respondent - Director of Mines and Geology, Hyderabad, Telangana to consider the application dated 18.01.2020 submitted by the petitioner and to pass necessary orders therein strictly in accordance with law, as expeditiously as possible preferably within a period of six (6) weeks from the date of receipt of a copy of this order. It is needless to mention that the 2nd respondent before passing adverse orders, if any, shall put the petitioner on notice and afford it an opportunity of hearing. No order as to costs. 5.
Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
