THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.15381 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for respondents. Notice to the seventh respondent is dispensed with in view of the relief granted in the present writ petition.

The petitioner states that he is an agriculturist having land to an extent of Acs.7.81 cents taken on lease from one K.Jagannadham in Survey Nos.160/1 and 160/2 of Rajavaram Village. They are situated on the western side of the prawn tanks of the seventh respondent. It is the allegation of the petitioner that the seventh respondent is undertaking prawn culture activity in an extent of Acs.99.81 cents situated in Rajavaram Village of Payakaraopeta Mandal, Visakhapatnam District, without any valid license and approval. The gram panchayath also did not pass any resolution in favour of the seventh respondent. The petitioner submitted a representation dated 30.03.2015 to the fourth respondent and inspite of it when the activity of the seventh respondent was not restrained, the present writ petition is filed.

Learned Government Pleader, on the basis of written instructions, submitted that the seventh respondent applied to the District Level Committee for issue of registration certificate by Coastal Aquaculture Authority, Chennai. The Revenue Divisional Officer, Narsipatnam has accorded permission for conversion of agricultural lands into non-agriculture purpose. The District Level Committee inspected the farm on 12.03.2015 and no decision has been taken as on today. The representation submitted by the petitioner to the District Collector, is taken into consideration by the District Level Committee.

In the circumstances, the writ petition is disposed of directing the District Level Committee to take into consideration the representation submitted by the petitioner to the District Collector before granting/recommending for permission to the seventh respondent.

Accordingly, the writ petition is disposed of. No costs. Miscellaneous petitions, if any, pending shall stand closed.
