THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.10906_OF 2016 ORDER:

Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor. Perused the material on record.

2. The present Criminal Petition came to be filed by the petitioners/A.1 & A.2 under Section 438 Cr.P.C., seeking release in the event of their arrest in Crime No.129 of 2016 of Asifnagar Police Station, Hyderabad, registered for the offences punishable under Sections 120-B, 406, 420, 498-A and 506 IPC. Originally, a private complaint has been filed before the VI Additional Chief Metropolitan Magistrate, Hyderabad, which was referred to police under Section 156(3) Cr.P.C., for investigation.

3. The case of the prosecution is that the marriage of the daughter of the informant with A.3 was performed on 24.08.2014. Out of wedlock, they blessed with a female child on 13.12.2015. From the date of marriage, A.3 at the instance of A.1 and A.2 started harassing the daughter of the informant physically and mentally. A.3 left India leaving the daughter of the informant by suppressing his neuro problem. Basing on these allegations, the present case came to be registered.

4. Learned counsel for the petitioners submits that allegations in the report are all false and invented for the purpose of this case and the petitioners being parents of A.3 are no way concerned with the offences alleged.

5. Learned Additional Public Prosecutor opposed the same.

6. A perusal of the material on record would show that the allegations are mainly directed against A.3. The petitioners, who are 60 years and 50 years respectively, are parents of A.3. No serious allegations are attributed against them. Hence, their request can be considered on certain terms and conditions.

7. The petitioners shall surrender before the concerned Court within a period of two (02) weeks from today and move an application for bail after giving prior notice to the learned Public Prosecutor. In which event, the same shall be considered, in accordance with law, on certain terms and conditions as the said Court deems fit and proper. It is to be noted that the Court below shall direct the petitioners to deposit their passports.
