Heard learned counsel for the revision petitioner before admission of the revision and perused the impugned order. 2) In view of the provisions covered by Chapter XXXIII of Cr.P.C particularly from the wording of Section 446 to 446 (A) Cr.P.C, amended from time to time, the Court below should have forfeited the bond and imposed penalty instead of issuing NBW to the surety. As the learned counsel for the revision petitioner submits in the course of hearing that, they are ready to pay the entire bond amount for the surety by obtaining fixed deposit as penalty, lower Court is directed, by virtue of this order, to forfeit the entire amount as penalty by canceling the NBW. 3) Accordingly, the revision is disposed of.
