The case of the petitioner is that he owns an extent of Ac.0-06 cents of land in Sy.No.154/4 at Kothapeta Village, Vetapalem Mandal, Prakasam District. When he wanted to sell the land, he approached the office of Sub-Registrar for obtaining details of market value. The Sub-Registrar issued Market Value Certificate dated 22-06-2016 and also contains that Sy.No.154/4 is assessed waste land as per Tahsildar, Vetapalem and it cannot be registered. Aggrieved by the same, the present writ petition is filed. Counter is filed by the 3rd respondent stating that subject land admeasuring Ac.1-86 cents in Sy.No.154/4A/19 is originally classified as Assessed waste land and later it was assigned to the landless poor persons. Hence, it is assigned land.
Learned counsel for the petitioner submits that the sale transactions took place and documents were registered in respect of said land since 1953 onwards and the land belongs to Veeramma W/o.V.Subbaiah of Kothapeta Village and she had gifted the same to one Nageswar Rao in the year 1952 and in the year 1966, he sold land to Hymavati W/o.Rama Krishna Rao vide document No.3000/1966. Later said Hymavathi sold this
land to Jagilamudi Venkateshwarlu on 15-04-1982 vide document No.1011 of 1982. The legal heirs of said Venkateshwarlu sold the land to the petitioner on 29-04-1994 vide document No.1106 of 1994. Counter does not say to whom the land was assigned and when the registration of the document in respect of said land has been done from 1953 onwards, it is not known, how the said land is treated as assigned land. No particulars have been mentioned.
In view of the same, the 4th respondent is directed to receive and register the document presented by the petitioner in respect of above land, provided if the same is in order as per the provisions of Stamp Act and Registration Act.
Accordingly, the writ petition is disposed of. As a sequel thereto, miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed.
