HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No. 1 5 9 3 5 of 2 0 1 8 ORDER: - Heard learned Counsel appearing for the petitioner and the learned Government Pleader appearing for the respondents. An order of suspension of license of the petitioner issued by the Prohibition & Excise Superintendent, Narasaraopet, vide Rc.No.66/ 2018/ A4, dated 23.04.2018, is under challenge in the present Writ Petition.

When the matter is taken up, a preliminary objection with regard to the maintainability of the Writ Petition is taken by the learned Government Pleader by contending that as against the order of suspension, the statutory appeal lies to the Deputy Commissioner of Prohibition and Excise under Section 63 of the A.P.Excise Act and without availing such remedy, the present Writ Petition has been filed. It is further submitted by the learned Government Pleader that enquiry is still pending before the Prohibition and Excise Superintendent and necessary final orders will be passed within a period of two weeks from today.

The said statement of the learned Government Pleader is recorded and the Writ Petition is accordingly disposed of, directing the 4th respondent to complete the enquiry and pass final orders pursuant to the impugned order within a period of two weeks from today, in accordance with law. It is open for the petitioner herein to file an explanation in response to the impugned order within a period of one week from today.

respondent shall pass the orders after considering such explanation.
