The petitioner/accused filed the present Criminal Petition under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to grant bail to him in Crime No.103 of 2026 of Yacharam Police Station, Future City, which was registered for the offences punishable under Sections 78(2) and 107 of Bharatiya Nyaya Sanhita, 2023 (for short "the BNS") and Section 11 read with Section 12 of the Protection of the Children from the Sexual Offences Act, 2012 (for short the 'Act').

Heard Mr. P.Ram Mohan, learned counsel appearing for the petitioner and Mr. D.Arun Kumar, learned Additional Public Prosecutor, appearing for the respondentState. Inspite of service of notice to the de facto complainant, there is no representation. Perused the record.

Learned counsel appearing for the petitioner would submit that, the petitioner is an innocent young man, aged 22 years. Admittedly, the petitioner is in contact with the deceased person and the Whats App chats would reveal that no such intimidation or abetment has been caused by the petitioner resulting in the death of the deceased person. Unfortunately, the deceased committed suicide on her own and it has been falsely alleged that the petitioner is the reason for commission of suicide by the deceased. He further submits that none of the Whats App chats disclose that the petitioner has ever harassed the deceased person and the petitioner was always in good terms with the deceased person, as they both are happy in expressing love against each other. He further submits that the petitioner

filed an application in Crl.M.P.No.365 of 2026 seeking bail before the learned Special Sessions Judge for Trial and Disposal of Cases under POCSO Act, Ranga Reddy District, at L.B. Nagar, but the same was dismissed on 05.05.2026. He further submits that the petitioner was remanded to judicial custody on 11.04.2026 and since then he is languishing in jail. He further submits that the petitioner is ready to abide by any of the conditions to be imposed by this Court and seeks to grant bail.

Learned Additional Public Prosecutor, on the other hand, would submit that, the investigation is in progress, where the statements of LWs.1 to 15 have already been recorded and post-mortem report has also been obtained and the statements of all the witnesses were recorded and the same are corroborated with each other. On 09.04.2026, the petitioner had threatened the deceased person and exerted pressure on her to love him or else to die. On the very same day, the deceased committed suicide and the said action of the petitioner amounts to abetment. He further submits that the investigation is under progress

and charge sheet would be laid in due course of time and enlarging the petitioner on bail at this stage is not warranted. Hence, he seeks to dismiss the criminal petition.

Having heard the learned counsel appearing on both sides and on examination of the material placed before this Court more particularly, the statement of LW-2, who is the grandmother of the deceased, wherein it is stated that when the petitioner was harassing the deceased, the father of the deceased warned the petitioner not to harass the deceased stating that she is not interested in him and disputes had arisen between the petitioner and the family of the deceased. On 09.04.2026, the parents of the deceased have went out to sell vegetables. At about 10.00 a.m., when the deceased and LW-2 were together in the house, the petitioner had entered into the house and threatened her to love him or to die and LW-2 had driven the petitioner out of the house. Thereafter, LW-2 saw the deceased dead at about 05.30 p.m. It is further stated that LW-2 is outside the house till 05.30 p.m. and when she

went inside, she found the deceased dead and raised hues and cries. The action taken by LW-2 during the interregnum period i.e., from 10.00 a.m. to 05.30 p.m. regarding the entry of the petitioner into their house was not explained. As to what transpired between the petitioner and the deceased person can only be known after conducting full-fledged investigation and filing of charge sheet by the Investigating Officer before the trial Court. Accordingly, the benefit of doubt is extended in favour of the petitioner and the petitioner/accused shall be released on bail on the following terms and conditions: (i) That the petitioner/accused shall execute a personal bond for Rs.25,000/- (Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of the learned Magistrate concerned.

(ii) On such release, the petitioner shall appear before Station House Officer concerned on every Monday and Friday between 10:00 a.m. and 02:00 pm for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) The petitioner shall cooperate with the Investigating Officer and shall not tamper with the evidence directly or indirectly.

(iv) The petitioner shall deposit his passport, if any, before the learned trial Court and he shall not leave the jurisdiction limits of the learned trial Court without prior permission.

(v) The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.(presently, Section 480(3) of the BNSS).

(vi) In the event of any breach of the above conditions, the respondent is at liberty to seek cancellation of the petitioner's bail.

Accordingly, the Criminal petition is allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
