THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5200 of 2019

ORDER

This petition is filed under Section 482 Cr.P.C., seeking to quash the proceedings in Crime No.902 of 2018 on the file of Kisaiguda Police Station, Rachakonda District, registered against the petitioners and others for the offences under Sections 406 and 420 IPC.

Though the petitioner has raised several grounds to quash the aforesaid proceedings, learned counsel for the petitioner requested this Court to direct the police concerned to follow the procedure under Section 41-A Cr.P.C and the guidelines issued by the Apex Court in Arnesh Kumar v. State of Bihar and another1. 3.

Acceding to the request of the learned counsel for petitioner, without going into the merits of the matter, the Criminal Petition is disposed of directing the police concerned to follow the procedure under Section 41-A Cr.P.C., and the guidelines issued by the Apex Court in Arnesh Kumar's case (supra). However, no coercive steps shall be taken against the petitioner/ A6 till filing of the final report. 4.

Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
