THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.5578 OF 2017 ORDER: (Oral) (Per the Hon'ble Sri Justice Suresh Kumar Kait) The preset petition is filed by the wife of the detenu who is alleged that her husband has been illegally taken by the police and detained illegally in the police station without any case registered against him on 08.02.2017.

2. Counter-affidavit filed by the respondent No.6, whereby stated that the detenu was arrested vide FIR No.31 of registered at Rajanagaram Police Station, Rajamahendravaram District, for the offences punishable under Section 8(c ) read with 20(b) (ii) (c) of NDPS Act , 1985.

3. We note that on the said date 440 Kgs of ganja was recovered from the detenu in the presence of Tahsildar-cumMandal Executive Magistrate, Rajanagaram Mandal at the spot at about 5.30 a.m.

4. In view of the counter-affidavit filed by the respondent No.6, there is no requirement to pass any further order in the present petition.

5. Accordingly, this Writ Petition is closed. There shall be no order as to costs.

Miscellaneous petitions, if any pending, shall stand closed.
