THE HON'BLE SRI JUSTI CE ABHI NAND KUMAR SHAVI LI WRI T PETI TI ON NO. 25184 OF 2004 ORDER:

This Writ petition is filed challenging the proceedings dated 2.7.2004 wherein the selections made by the 3rd respondent were cancelled.

Learned counsel for the petitioner contends that the 3rd respondent institution had issued a notification calling for applications for the post of S.G.B.T. teacher. The petitioner had responded to the said notification and after undergoing regular selection process, he was selected but no appointment orders were issued. The District Educational Officer had forwarded the proposals of the selection Committee to the Commissioner and Director of School Education. The Commissioner and Director of school Education vide orders dated 8.6.2004 cancelled the selections and in pursuance thereto, the District Educational Officer had issued consequential proceedings dated 2.7.2004 cancelling the selections on the ground that the 3rd respondent management has not followed the rosters. Challenging the same, the petitioner had filed this Writ Petition.

Since the petitioner was not appointed, no right has accrued to him to challenge the selections. Unless and until appointment order is given to the petitioner, the petitioner cannot be said to be an aggrieved person. The selections conducted by the 3rd respondent were cancelled even before appointment orders were issued.

In view of the same, this Court cannot interfere on the ground that there is no legal right to the petitioner to seek appointment to the post of S.G.B.T. Teacher.

There are no merits in the Writ Petition and accordingly, the Writ Petition is dismissed.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
