THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.3369 OF 2015 ORDER:

The petitioner has preferred the present criminal revision case by invoking the provisions under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.,) being aggrieved by the order dated 28.12.2015 passed in Crl.M.P.No.1232 of 2015 in Crl.M.P.No.732 of 2014 in C.C.No.225 of 2015 by the Court of the Principal District and Sessions Judge, Nalgonda, whereby the Court below dismissed the application filed under Section 439 CrPC seeking to relax the condition imposed in Crl.M.P.No.732 of 2015 in crime No.143 of 2012 of Nalgonda I Town P.S., Nalgonda District.

Heard and perused the material available on record. The learned trial Judge dismissed the application filed by the petitioner to relax the condition imposed on the petitioner in Crl.M.P.No.732 of 2014 to deposit the passport of the petitioner herein before the Court below and that she shall not leave the jurisdiction of the Nalgonda District without prior permission of the Court. Learned counsel for the petitioner submits that the petitioner has to go to United States of America (USA) to lookafter her grandson and as such, prays this Court to set aside the order impugned and allow the petitioner to go to USA.

In the facts and circumstances of the case, the petitioner is directed to file an application before the Court below stating when she is leaving abroad and when she would be coming to India and on such application being filed, the Court below is directed to return the passport to the petitioner herein on execution of a personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with one surety to the satisfaction of the Magistrate concerned. The petitioner is also directed to report before the Court immediately on her arrival to India and also furnish the address of the petitioner to the Court below, to

which the summons are to be served.

With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions pending in this revision, if any, shall stand closed.
