ORDER

The petitioner-accused filed the present application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking to grant bail to him in Crime No.717 of 2026 of Gachibowli Police Station, Cyberabad, Ranga Reddy District, registered for the offences punishable under Sections 69 and 351(2) of the Bharatiya Nyaya Sanhitha, 2023.

The brief facts of the case are that the petitioner developed illicit relationship with the complainant and exploited her sexually. Thereafter, the petitioner harassed the complainant by threatening her that he will upload her private videos in social media platforms. Hence, a case was registered against the petitioner.

Heard Mr.Sanjeev Reddy Gillela, learned counsel appearing on behalf of the petitioner as well as Mr.Vivekananda Reddy, learned Assistant Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submits that the petitioner and the complainant were in consensual relationship for the past four (04) years and solely on the allegation that the petitioner is threatening the complainant to circulate her private videos, the complaint has been filed and he has been apprehended. Therefore, he prayed the Court to grant bail to the petitioner by allowing this Criminal Petition.

On the other hand, learned Additional Public Prosecutor opposed for grant of bail contending that the statements of the witnesses have been recorded and there is no evidence of circulation of any private videos of the complainant in social media as of now. Therefore, he prayed the Court to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and on perusal of the material available on record, it appears that the present crime was registered solely based on the allegation that the petitioner is threatening to circulate the private videos of the complainant. However, there is no evidence of

circulation of any private videos of the complainant in social media as of now. Considering the facts and circumstances of the case, this Court deems it fit to grant bail to the petitioner/accused subject to the following conditions:

(i) The petitioner shall execute a personal bond for Rs.50,000/- (Rupees Fifty thousand only) with two sureties for a like sum each to the satisfaction of the II Additional Junior Civil Judge-Cum-X Judicial Magistrate of First Class, Ranga Reddy District at Kukatpally.

(ii) The petitioner shall abide by the other conditions stipulated in Section 480(3) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

(iii) The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m., and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
