THE HON'BLE SRI JUSTICE NOOTY RAMAMOHANA RAO WRIT PETITION No. 11264 OF 2015 O R D E R:
The petitioner is working as a Field Assistant, Kadiripalli Gram Panchayat of Guntakal Mandal, Anantapur District under the Mahatma Gandhi National Rural Employment Guarantee Scheme. His services have been terminated by the Project Director by the orders passed on 16.09.2014. Since an Appeal would lie against such an order, the petitioner appears to have submitted an Appeal to the District Collector, Anantapur. The said Appeal is dated 30.10.2014. Though there is no acknowledgment to show that it has been received by the Collector's Office, more than five months' period has already elapsed from the date of Appeal.
Therefore, it would only be appropriate that the Collector shall deal with the Appeal of the petitioner on merits as expeditiously as is possible and dispose it of within two months from the date of receipt of a copy of this order. Learned counsel for the petitioner would submit that in somewhat similar circumstances, entertaining Writ Petition No. 30018 of 2010, an order was passed by this Court on 05.11.2013. It is for the petitioner to bring to the notice of the Collector the orders passed by this Court in Writ Petition No. 30018 of 2010 and urge before him for a similar exercise to be indulged in and upon application of his mind, the Collector will be able to decide the matter. With this, the Writ Petition stands disposed of after hearing Sri M.S.R. Chandra Murthy, learned Standing Counsel for the 3rd respondent. No costs.
Consequently, the miscellaneous applications, if any shall also stand disposed of.
