This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who are arrayed as accused Nos.1 and 2 in Crime No.173 of 2026 of Nizamabad I Town Police Station, Nizamabad District, registered for the offences punishable under Section 109(1) read with 3(5) of Bharatiya Nyaya Sanhitha, 2023 (for short 'BNS').

The brief facts of the case are that on 06.06.2026 at about 20:15 hours, the complainant lodged a complaint regarding an alleged attempt on the life of his elder sister, Smt. Thabbasum Naheed. According to the complaint, Smt. Thabbasum Naheed was married to Mohammed Rehan, resident of Fruit Market, Nizamabad. It is alleged that for the past five to six months, disputes had arisen between the deceased and her husband as well as her in-laws in connection with marital issues. The complainant further stated that on 05.06.2026 at about 4:00 PM, Mohammed Rehan brought his wife to their house in an unconscious condition. Thereafter, the family members admitted her to Amrutha Laxmi Hospital, Nizamabad, for treatment. It is alleged that on 06.06.2026 at about 11:00 AM, after regaining consciousness, Smt.

Thabbasum Naheed informed the complainant and family members that her husband, Mohammed Rehan, along with her mother-in-law, Sarwath Begum, had forcibly made her consume "ALL OUT" mosquito repellent liquid with an intention to kill her. She also stated that she had recorded a video of the incident in her mobile phone. The complainant further alleged that Mohammed Rehan had behaved similarly

on earlier occasions as well. Based on the said allegations, the complainant requested the police to take necessary legal action against the accused persons. Hence, action was sought against the accused.

Heard Mr.K.Venumadhav, learned Counsel appearing on behalf of the petitioners as well as Mr.Vivekananda Reddy, learned Assistant Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioners submits that the petitioners are accused Nos.1 and 2 and the accusations are that they have made the complainant to take All-Out liquid with an intention to kill her. Further submits that petitioners themselves have taken complainant to the hospital and there was no intention to kill the complainant. Therefore, he prayed for grant of pre-arrest bail by allowing the Criminal Petition. 5.

On the other hand, learned Public Prosecutor opposed the grant of bail and submits that investigation is yet to be completed and medical report is also awaited. Therefore, at this stage, granting of pre-arrest bail to the petitioners does

not arise. Hence, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and since there is no evidence of the complainant having consumed All-Out liquid, this Court is inclined to grant pre-arrest bail to the petitioners/accused Nos.1 and 2, subject to the following conditions:

i.

The petitioners-accused Nos.1 and 2 shall surrender before the Station House Officer, Nizamabad I Town Police Station, Nizamabad District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.25,000/-, each with two sureties, for the like sum each.

ii.

The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

iii.

The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
