Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. With the consent of parties, the Writ Petition is being disposed of at the stage of admission.

The petitioner was appointed as a fair price shop dealer of F.P.Shop No.30, Kalavalla Village, Valetivaripalem Mandal, Prakasam District. The authorization is valid upto 31.03.2013. The petitioner remitted challan seeking renewal on 04.04.2013. It appears that one barrel of kerosene oil (i.e. 140 ltrs.) belonging to the petitioner was stolen on 19.09.2014 and, in that context, he lodged a complaint before the Sub-Inspector of Police, Valetivaripalem Police Station, and a case was registered in Crime No.70 of 2014. On the same day, the shop was inspected and a report was submitted by the Enforcement Deputy Tahsildar, Valetivaripalem, Prakasam District Based on the said report, the third respondent issued show cause notice dated 20.09.2014, to which the petitioner submitted his explanation on 29.10.2014.

The third respondent, by the impugned proceedings dated 31.03.2015, cancelled the authorization of the petitioner. Against the impugned order proceedings dated 31.03.2015, the petitioner preferred an appeal, along with a stay petition, to the second respondent. Neither the stay petition nor the appeal was disposed of by the second respondent and, hence, the present Writ Petition is filed.

This Court is inclined to direct the second respondent to complete the enquiry, by giving due opportunity to the petitioner to submit his explanation, within a period of thirty days from the date of receipt of a copy of this order, taking into consideration the complaint lodged by the petitioner regarding theft of 140 ltrs. of Kerosene oil.
