THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.5155 OF 2018 ORDER:

This criminal petition is filed under Section 482 Cr.P.C, challenging the order in Crl.M.P.No.584 of 2018 in C.C.No.71 of 2018 on 18.04.2018 passed by the VII Metropolitan Magistrate Cyberabad at Hayathnagar, whereby, the petition filed under Section 70(2) Cr.P.C to recall the NBW issued against this petitioner was dismissed. The reason for dismissal of the petition was that the petitioner did not appear and sought for recalling of NBW under Section 70(2) Cr.P.C.

Learned counsel for the petitioner reiterated the grounds urged in the petition while relying on the judgment of this Court in Mita Cats Pvt. Ltd v. G.E. Countrywide Consumer Financial Services Limited1.

In any view of the matter, the petitioner is directed to appear before the VII Metropolitan Magistrate Cyberabad at Hayathnagar on 11.06.2018 and on such appearance and in any event of filing any application under Section 70(2) Cr.P.C, the VII Metropolitan Magistrate Cyberabad at Hayathnagar is directed to pass appropriate order in accordance with law on the same day. With the above direction, the criminal petition is disposed of. Consequently, miscellaneous applications pending if any, shall also stand closed. No costs.
