HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No. 9672 of 2009 ORDER:

The petitioner seeks writ of Mandamus declaring the inaction of respondent in finalizing the claim of petitioner for grant of pension under Freedom Fighters Family Pension Scheme-1980 in the light of the letter No.112/2985/84-FF(HC)(B), dated 01.08.2005, as illegal, arbitrary, contrary to record and in violation of principles of natural justice and consequently to direct respondent to finalize the claim of petitioner for grant of pension.

This Court, on 01.05.2009 in W.P.M.P.No.12593 of 2009 granted interim direction to the effect that respondent has to consider the claim of petitioner for grant of pension in the light of Letter No.112/2985/84FF(HC)(B), dated 01.08.2005 and pass appropriate orders. 3.

When the matter came up for hearing today, learned counsel for petitioner would submit that in view of the interim order, no further orders are required in the writ petition and hence, the same may be closed.

Recording the above submission of learned counsel for petitioner, the writ petition is dismissed accordingly. No costs. As a sequel, miscellaneous petitions pending if any, shall stand closed.
