This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.202/2016 on the file of VII Metropolitan Magistrate, Cyberabad, Hayatnagar, registered against the petitioner/A-2, for the offence punishable under Section 420 and 120-B of IPC. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.
A perusal of the material on record reveals that specific allegations were made against the petitioner. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.
In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the criminal petition is disposed of, directing the trial court to dispose of the case as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of this order. The presence of the petitioner / A2 shall not be insisted upon on each and every date of hearing, unless required for any specific purpose. Miscellaneous petitions pending if any, shall stand closed.
