HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.5208 of 2019 O R D E R :
This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 is filed by the petitioners, who are A.1, A.3 and A.4, for grant of anticipatory bail in the event of their arrest in Crime No.118 of 2019 of Utnoor Police Station, Adilabad District, registered for the offence punishable under Section 306 read with 34 IPC.
The facts of the case in brief are that the above crime is registered basing on the complaint of the defacto complainant-Jadhav Manoj stating that since one year from the date of complaint, one Rathod Vinod-1st petitioner of their village kept on harassing his sister by name Praveena under pretext of love and marriage. Later his sister got GNM job but said Rathod Vinod even went there and harassed her which was known by one Prahallad and on whose advise Rathod Vinod tried to apply herbal medicine to Praveena given by one Ramdhan-2nd petitioner. On knowing the same, the family of the defacto-complainant agreed for performing marriage of Praveena with Rathod Vinod. Thereafter one Premdas-3rd petitioner, brother-in-law of Rathod Vinod demanded Rs.2,00,000/- and one motor cycle towards dowry. His sister unable to bear their harassment, on 09.05.2019 at about 5.00p.m. in the absence of family members in the house, consumed unknown pesticide and attempted to commit suicide and on the same day, they shifted to Govt. Hospital,
Utnoor and on the advise of doctors again shifted her to RIMS Hospital, Adilabad, where she died while undergoing treatment.
Heard learned counsel for the petitioners/accused and the learned Additional Public Prosecutor appearing for the respondent-State. Perused the material on record. Learned counsel for the petitioners contend that the petitioners are innocent of the offences alleged, that they have not committed any offence and they have been falsely implicated in the above crime. It is also submitted that the deceased and the petitioner No.1 were in deep love with each other which was not liked by the defacto-complainant and he searched for other matches.
Unable to digest this development, the deceased suggested to the petitioner No.1 to come to their house and speak with elders, for which the petitioner No.1 requested two days time. In the meantime due to humiliations in the hands of defacto-complainant, the deceased consumed unknown pesticide poison and attempted to commit suicide. It is further submitted that the petitioner No.1 never demanded dowry and he was not aware of the developments in the family of the deceased and never harassed the deceased. It is further submitted that they are no way responsible for the death of Praveena. On the other hand, the learned Additional Public Prosecutor vehemently opposed the relief sought in the above petition.
As seen from the contents of the complaint, there are specific allegations against the petitioners particularly the petitioner No.1 harassed the deceased under the guise of love and marriage and the other petitioners helped him which forced her to commit suicide.
Thus, in view of the specific and serious nature of allegations levelled against the petitioners and facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioners.
Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
