HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.10802 of 2007 ORDER:

This writ petition is filed to declare the notification dated 27.04.2007 issued under Section 5-A of the Land Acquisition Act, as illegal and arbitrary.

2. Today, when the matter came up for hearing, learned Assistant Government Pleader passed on the written instructions of the Revenue Divisional Officer, Eluru dated 23.12.2017, which are placed on record. According to the said written instructions, the Revenue Divisional Officer states that there is no requirement of the land for acquisition, as alternative land was already taken and distributed as house sites.

3. In view of the written instructions of the Revenue Divisional Officer, Eluru, dated 23.12.2017, no further orders are required to be passed in this writ petition and the writ petition is liable to be closed.

4. Accordingly, the writ petition is closed. No order as to costs. Pending miscellaneous petitions, if any, in this writ petition, shall stand closed.
