THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 4711 of 2022 ORDER:

This Criminal Petition is filed under Section 437 & 439 of the Code of Criminal Procedure,' 1973 (for short "Cr.P.C.") seeking regular bail to the petitioner/Accused in Crime No.19 of 2022 on the file of GRP Secunderabad, R.P.S. Khammam, registered for the offences punishable under Sections 20 (b) read with 8 (c) of NDPS Act. 2.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

The case against the petitioner is that he was arrested on 05.02.2022 for being in possession of four bags containing ganja. He was remanded to judicial custody on 05.02.2022. The samples drawn from the contraband was sent to FSL and, after receipt of FSL report, a charge sheet was filed.

Learned counsel for the petitioner submits that investigation is complete and charge sheet is already filed. There are no other criminal antecedents against the petitioner being involved in similar cases. 5.

Since the investigation is complete, this Court is of the opinion that the petitioner/Accused can be granted bail subject to the following conditions.

i. The petitioner/Accused is directed to be released on bail on executing personal bond for a sum of Rs.50,000/-(Rupees Fifty thousand only) with two sureties, of which one local from his native place, for a like sum each to the satisfaction of the Special Sessions Judge for the Trial of Cases under NDPS Act-cum-I Additional Sessions Judge at Warangal. ii. On such release, the petitioner/Accused shall appear before the concerned trial Court on every date of hearing, failing which bail is liable to be cancelled. iii. The Petitioner/Accused shall abide by the other conditions stipulated in Section 437 (3) of Cr.P.C. 6.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
