HON'BLE SRI JUSTICE SURESH KUMAR KAIT Writ Petition No.31960 of 2016 ORDER:

Vide present writ petition, the petitioner seeks a direction, thereby directing the respondents to consider and dispose of the petitioner's representations dated 16.07.2016 and 31.08.2016 for payment of legitimate compensation to the petitioner under the provisions of Act 30 of 2013.

2. Learned counsel for the petitioner submits that the House bearing D.No.4-20, Namnoor village, Mancherial Mandal, Adilabad District, was acquired in the year 2008 for submergence of Sripada Yellampally Project and the award was passed in respect of others. However, in respect of the petitioner, the draft award has already sent by the 3rd respondent to the 2nd respondent for approval vide his proceedings No.A/ 21/ 2008, dated 06.08.2015, but the said respondent has not taken any decision. Thus, non-payment of legitimate compensation under the Act 30 of 2013 till date, prejudice and hardship is causing day to day to the petitioner.

3. Notice issued. Leaned Government Pleader for Land Acquisition (Telangana) accepted the notice on behalf of respondents 2 and 3 and submits that the 2nd respondent shall take its decision within the time stipulated by this court.

4. Keeping in view the facts recorded above and the submissions of the learned counsel for both parties, I hereby direct the 2nd respondent to take decision on the aforesaid representations made by petitioner, within four weeks from the date of receipt of a copy of this

order and the decision taken thereon shall be communicated to the petitioner within one week thereafter.

5. With the above direction, this writ petition is disposed of. No order as to costs. Pending miscellaneous petitions, if any, in this petition, shall stand closed.
