THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.4706 OF 2022 ORDER:
This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who is arrayed as Accused No.2 in the event of her arrest in Crime No.20 of 2022 on the file of Yadagirigutta Police Station, Yadadri-Bhuvanagiri District, registered for the offences punishable under Sections 498-A and 306 read with Section 34 of Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act, 1961.

Heard learned counsel for petitioner/Accused No.2 and learned Assistant Public Prosecutor for respondent-State. Perused the record.

The case of the prosecution is that the petitioner is the mother of Accused No.1. The daughter-in-law of Accused No.2 and wife of Accused No.1 committed suicide, for the reason of alleged harassment by Accused No.1 and this petitioner who is mother of Accused No.1.

As seen from the complaint, there are no specific allegations against this petitioner and they are living together under one roof. In the background of Accused No.1 being arrested and there being no specific allegations against this petitioner, the petitioner/Accused No.2 can be granted the relief of anticipatory bail. 5.
Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.2 shall be enlarged on bail in the event of her arrest subject to the following conditions: i) The petitioner/Accused No.2 is directed to surrender before the Station House Officer, Yadagirigutta Police Station, YadadriBhuvanagiri District within one week from today, and on such surrender, she shall be enlarged on bail on her executing a personal bond for a sum of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties to the like sum each to its satisfaction. ii) On such release, the petitioner/Accused No.2 shall appear before the investigating authorities as and when required. iii) The petitioner/Accused shall abide by the other conditions stipulated in Section 438(2) Cr.P.C.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
