THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.15842 of 2018 ORDER:

In this Writ Petition, under Article 226 of the Constitution of India, the main grievance of the writ petitioner is the inaction of the 4th respondent in registering a case/crime on the complaint, dated 29.11.2017, lodged by the petitioner, under Acknowledgement, dated 29.11.2017, issued by the Station House Officer, Bhoothpur Police Station, Bhoothpur, Mahabubnagar/4th respondent herein.

I have heard the submissions of Sri R.N.Hemendranath Reddy, learned counsel appearing for the petitioner, and of the learned Government Pleader for Home (Telangana), appearing for the respondents 1, 2 & 4, and of the learned Government Pleader for Revenue (Telangana), appearing for the respondents 3 to 5. I have perused the material record.

At the hearing, learned Government Pleader for Home, on written instructions, dated 27.04.2018, would submit that on receipt of the said report, an entry is made in the General Diary of the Police Station and that a preliminary enquiry is undertaken.

Learned counsel for the petitioner submits that on receipt of the complaint, instead of registering a crime and proceeding with the investigation, the Police Officer advised the petitioner to go to a civil Court and, therefore, the petitioner is aggrieved.

Having regard to the facts and submissions, the Writ Petition is disposed of directing the 4th respondent to take suitable action on the complaint of the petitioner, following the precedential guidelines in the decision reported in Lalita Kumari Vs. Government of Uttar Pradesh1, as expeditiously as possible. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
